Статья 62

1. Гражданин Российской Федерации может иметь гражданство иностранного государства (двойное гражданство) в соответствии с федеральным законом или международным договором Российской Федерации.

2. Наличие у гражданина Российской Федерации гражданства иностранного государства не умаляет его прав и свобод и не освобождает от обязанностей, вытекающих из российского гражданства, если иное не предусмотрено федеральным законом или международным договором Российской Федерации.

3. Иностранные граждане и лица без гражданства пользуются в Российской Федерации правами и несут обязанности наравне с гражданами Российской Федерации, кроме случаев, установленных федеральным законом или международным договором Российской Федерации.

Статья 869. Безотзывный аккредитив

1. Безотзывным признается аккредитив, который не может быть отменен без согласия получателя средств.

2. По просьбе банка-эмитента исполняющий банк, участвующий в проведении аккредитивной операции, может подтвердить безотзывный аккредитив (подтвержденный аккредитив). Такое подтверждение означает принятие исполняющим банком дополнительного к обязательству банка-эмитента обязательства произвести платеж в соответствии с условиями аккредитива.

Безотзывный аккредитив, подтвержденный исполняющим банком, не может быть изменен или отменен без согласия исполняющего банка.

Статья 876. Извещение о проведенных операциях

1. Если платеж и (или) акцепт не были получены, исполняющий банк обязан немедленно известить банк-эмитент о причинах неплатежа или отказа от акцепта.

Банк-эмитент обязан немедленно информировать об этом клиента, запросив у него указания относительно дальнейших действий.

2. При неполучении указаний о дальнейших действиях в срок, установленный банковскими правилами, а при его отсутствии в разумный срок исполняющий банк вправе возвратить документы банку-эмитенту.

FUNCTIONS AND POWERS

Article 10

The General Assembly may discuss any questions or any matters within the scope of the present Charter or relating to the powers and functions of any organs provided for in the present Charter, and, except as provided in Article 12, may make recommendations to the Members of the United Nations or to the, Security Council or to both on, any such questions or matters.

Article 11

1. The General Assembly may consider the general principles of co-operation in the maintenance of international peace and security, including the principles governing disarmament and the regulation of armaments, and may make recommendations with regard to such principles to the Members or to the Security Council or to both.

2. The General Assembly may discuss any questions relating to the maintenance of international peace and security brought before it by any Member of the United Nations, or by the Security Council, or by a State which is not a Member of the United Nations in accordance with Article 35, paragraph 2, and, except as provided in Article 12, may make recommendations with regard to any such questions to the State or States concerned or to the Security Council or to both. Any such question on which action is necessary shall be referred to the Security Council by the General Assembly either before or after discussion.

3. The General Assembly may call the attention of the Security Council to situations which are likely to endanger international peace and security.

4. The powers of the General Assembly set forth in this Article shall not limit the general scope of Article 10.

Любой такой вопрос, по которому необходимо предпринять действие, передается Генеральной Ассамблеей Совету Безопасности до или после обсуждения. 

3. Генеральная Ассамблея может обращать внимание Совета Безопасности на ситуации, которые могли бы угрожать международному миру и безопасности.

Chapter 265: Section 1 Murder defined

Section 1. Murder committed with deliberately premeditated malice aforethought, or with extreme atrocity or cruelty, or in the commission or attempted commission of a crime punishable with death or imprisonment for life, is murder in the first degree. Murder which does not appear to be in the first degree is murder in the second degree. Petit treason shall be prosecuted and punished as murder. The degree of murder shall be found by the jury.

RIGHT TO LIFE

I. Everyone’s right to life shall be protected by law. No one shall be deprived of his life intentionally save in the execution of a sentence of a court following his conviction of a crime for which this penalty is provided by law.

2. Deprivation of life shall not be regarded as inflicted in contravention of this Article when it results from the use of force which is no more than absolutely necessary:

(a) in defence of any person from unlawful violence;

(b) in order to effect a lawful arrest or to prevent the escape of a person lawfully detained;

(c) in action lawfully taken for the purpose of quelling a riot or insurrection.

ARTICLE 3

PROHIBITION OF TORTURE

No one shall be subjected to torture or to inhuman, or degrading treatment or punishment.

ARTICLE 4

PROHIBITION OF SLAVERY AND FORCED LABOUR

1. No one shall be held in slavery or servitude.

2. No one shall be required to perform forced or compulsory labour.

3. For the purpose of this Article the term »forced or compulsory labour» shall not include:

(a) any work required to be done in the ordinary coarse of detention imposed according to the provisions of Article 5 of this Convention or during conditional release from such detention;

(b) any service of a military character or, in case of conscientious objectors in countries where they are recognised, service exacted instead of compulsory military service;

(c) any service exacted in case of an emergency or calamity threatening the life or well-being of the community;

(d) any work or service which forms part of normal civic obligations.

It is the continuing duty of the Industrial Welfare Commission, hereinafter referred to in this chapter as the commission, to ascertain the wages paid to all employees in this state, to ascertain the hours and conditions of labor and employment in the various occupations, trades, and industries in which employees are employed in this state, and to investigate the health, safety, and welfare of those employees.

The commission shall conduct a full review of the adequacy of the minimum wage at least once every two years. The commission may, upon its own motion or upon petition, amend or rescind any order or portion of any order or adopt an order covering any occupation, trade, or industry not covered by an existing order pursuant to this chapter.

Before adopting any new rules, regulations, or policies, the commission shall consult with the Occupational Safety and Health Standards Board to determine those areas and subject matters where the respective jurisdictions of the commission and the Occupational Safety and Health Standards Board overlap. This consultation need not take the form of a joint meeting. In the case of such overlapping jurisdiction, the Occupational Safety and Health Standards Board shall have exclusive jurisdiction, and rules, regulations, or policies of the commission on the same subject have no force or effect.

4300. Upon application for registration of a vehicle previously registered outside this State, the application shall be certified by the applicant and shall state that the vehicle previously has been registered outside this State, the time and place of the last registration of such vehicle outside this State, the name and address of the governmental officer, agency, or authority making the registration, and such further information relative to its previous registration as may reasonably be required by the department, including the time and place of original registration, if known, and if different from the last foreign registration.

4300.5. An application for registration under this chapter of a vehicle previously registered outside of this state shall be accompanied by payment of the amount required to be paid under Part 1 (commencing with Section 6001) of Division 2 of the Revenue and Taxation Code with respect to the use of the vehicle by the applicant.

4301. The applicant shall surrender to the department all unexpired license plates, seals, certificates, or other evidence of foreign registration as may be in his possession or under his control. The department may require a certification from the jurisdiction of last registry when the applicant fails to surrender the last issued unexpired license plates.

4302. Upon application made at the time of their surrender to the department and upon payment of a fee of one dollar ($1), the department shall return the unexpired license plates to the official in charge of the registration of motor vehicles in the state of issue of the license plates.

ARTICLE 2

OBJECTIVE

The ultimate objective of this Convention and any related legal instruments that the Conference of the Parties may adopt is to achieve, in accordance with the relevant provisions of the Convention, stabilization of greenhouse gas concentrations in the atmosphere at a level that would prevent dangerous anthropogenic interference with the climate system. Such a level should be achieved within a time-frame sufficient to allow ecosystems to adapt naturally to climate change, to ensure that food production is not threatened and to enable economic development to proceed in a sustainable manner.

CONVENTION SETTING UP A EUROPEAN UNIVERSITY INSTITUTE

PRINCIPLES GOVERNING THE SETTING UP OF THE INSTITUTE

Article 1

By this Convention, the Member States of the European Communities (hereinafter called the «Contracting States») jointly set up the European University Institute (hereinafter called the «Institute»). It shall have legal personality. The seat of the Institute shall be in Florence.

Article 2

1. The aim of the Institute shall be to contribute, by its activities in the fields of higher education and research, to the development of the cultural and scientific heritage of Europe, as a whole and in its constituent parts. Its work shall also be concerned with the great movements and institutions which characterize the history and development of Europe. It shall take into account relations with cultures outside Europe.

This aim shall be pursued through teaching and research at the highest university level.

2. The Institute should also be a forum for the exchange and discussion of ideas and experience in subjects falling within the areas of study and research with which it is concerned.

Article 3

1. The Contracting States shall take all the measures necessary to facilitate the pursuit of the aim of the Institute while observing freedom of research and teaching.

2. The Contracting States shall encourage the spread of the Institute’s influence in the scientific and university world. To this end, they shall assist the Institute to establish appropriate bonds of cooperation with the universities and scientific institutions in their territories and with the European and international bodies concerned with education, culture and research.

3. Within its terms of reference, the Institute shall cooperate with universities and with any national or international teaching or research body wishing to cooperate. It may conclude agreements with States and international bodies.

Article 4

The Institute and its staff shall enjoy such privileges and immunities as are necessary for the performance of their tasks, under the conditions laid down in the Protocol annexed to this Convention, which forms an integral part thereof. The Institute shall conclude a headquarters agreement with the Italian Government, to be approved unanimously by the High Council.

on standards for security features and biometrics in passports and travel documents issued by Member States

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 62(2)(a) thereof,

Having regard to the proposal from the Commission (1),

Having regard to the opinion of the European Parliament (2),

Whereas:

(1) The European Council of Thessaloniki, on 19 and 20 June 2003, confirmed that a coherent approach is needed in the European Union on biometric identifiers or biometric data for documents for third country nationals, European Union citizens’ passports and information systems (VIS and SIS II).

(2) Minimum security standards for passports were introduced by a Resolution of the representatives of the Governments of the Member States, meeting within the Council, on 17 October 2000. It is now appropriate to upgrade this Resolution by a Community measure in order to achieve enhanced harmonised security standards for passports and travel documents to protect against falsification. At the same time biometric identifiers should be integrated in the passport or travel document in order to establish a reliable link between the genuine holder and the document.

(3) The harmonisation of security features and the integration of biometric identifiers is an important step towards the use of new elements in the perspective of future developments at European level, which render the travel document more secure and establish a more reliable link between the holder and the passport and the travel document as an important contribution to ensuring that it is protected against fraudulent use. The specifications of the International Civil Aviation Organisation (ICAO), and in particular those set out in Document 9303 on machine readable travel documents, should be taken into account.

(4) This Regulation is limited to the harmonisation of the security features including biometric identifiers for the passports and travel documents of the Member States. The designation of the authorities and bodies authorized to have access to the data contained in the storage medium of documents is a matter of national legislation, subject to any relevant provisions of Community law, European Union law or international agreements.

(5) This Regulation should lay down only such specifications that are not secret. These specifications need to be supplemented by specifications which may remain secret in order to prevent the risk of counterfeiting and falsifications. Such additional technical specifications should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission (4).

Northern Foreign Policy

The Northern Dimension of Canada’s Foreign Policy (NDFP) sets out a vision for Canada in the circumpolar world, based on cooperation with Northerners and our circumpolar neighbours. The northern foreign policy promotes Canadian interests and values as we work to address the issues we have in common with our northern partners.

NDFP Objectives

The NDFP is framed by three principles — meeting our commitments and taking a leadership role; establishing partnerships within and beyond government; and engaging in ongoing dialogue with Canadians, northerners in particular. In keeping with this framework, the Northern Dimension of Canada’s Foreign Policy will have four overarching objectives:

to enhance the security and prosperity of Canadians, especially northerners and Aboriginal peoples;

to assert and ensure the preservation of Canada’s sovereignty in the North;

to establish the Circumpolar region as a vibrant geopolitical entity integrated into a rules-based international system; and

to promote the human security of northerners and the sustainable development of the Arctic.

Canadian Priorities

The following five Canadian priorities in the circumpolar world directly reflect the objectives set out in the NDFP: strengthening the Arctic Council; establishing a University of the Arctic and a Canadian and circumpolar policy research network; working with Russia to address its northern challenges; promoting sustainable economic opportunities and trade in the North; and increasing northern cooperation with the European Union and circumpolar countries. Various federal departments involved in the Arctic work towards these priorities together, in partnership with provincial, territorial and international governments, and northern stakeholders.
